Nearwater Hearing Delayed

Tonight's Planning and Zoning public hearing on Nearwater Lane will be opened, then immediately continued to April 12, according to the agenda.

Nearwater Lane Hearing Cancelled

Last night’s Planning & Zoning public hearing was cancelled. The Nearwater Lane application may need to be resubmitted in light of the Environmental Protection Commission’s decision that they have jurisdiction over the proposal. According to the statute governing local zoning (section 8-3g), the inland wetlands application must be filed at the same time as or earlier than the local zoning application. The statute states “If a site plan application involves an activity regulated pursuant to sections 22a-36 to 22a-45, inclusive, the applicant shall submit an application for a permit to the agency responsible for administration of the inland wetlands regulations not later than the day such application is filed with the zoning commission”. In that case, the applicants would have to submit a new EPC application first or submit the P & Z and EPC applications simultaneously.

Nearwater Lane Development Proposal

On November 1, the Planning and Zoning Commission held a public hearing on "Application for Approval of Affordable Housing, Coastal Site Plan Review #150-A, Land Filling & Regrading Application #147, Christopher and Margaret Stefanoni, 77 Nearwater Lane".
